Automatic Payments Authorization — Terms and Conditions


Automatic payment authorization by providing a valid payment method and clicking “ACCEPT Box,” guest authorizes Tri City Furnished Homes LLC to automatically charge the card on file for all lodging charges, taxes, fees, and other amounts due under the reservation and this agreement. Charges will occur on or after the 15th day of each month (local time zone) for monthly reservations, or as otherwise scheduled for weekly/daily reservations where recurring billing applies.


Recurring Billing Date and Amounts:

Guest agrees that monthly rental payments (and any recurring fees disclosed in the reservation) will be charged on the 15th of every month during the reservation term. If the reservation begins mid-month, a prorated initial charge may occur to align the billing cycle to the 15th; thereafter, full monthly charges will process on or after the 15th until the reservation ends or is canceled in accordance with the cancellation terms.


Transaction Fee:

Each payment is subject to a nonrefundable electronic processing fee of 3.9% of the total transaction amount, which will be charged in addition to the base lodging rate, taxes, and any other applicable charges.


Late Fee and Failed/Returned Payments:

If any payment is declined, returned, or otherwise not successfully processed on the due date, a late fee equal to ten percent (10%) of the total amount due will be assessed. Guest remains responsible for the unpaid balance, the late fee, and any additional costs or penalties permitted under this agreement, including interest and collection costs as allowed by law.


Cards On File and Backup Payment Methods:

Guest agrees to maintain at least one valid, unexpired payment card on file at all times during the reservation. If the primary card is declined, guest authorizes Tri City Furnished Homes LLC to attempt charges to any other card(s) on file, in any order, for the full amount due, including fees. Guest is responsible for promptly updating expired or replaced cards.


Authorization To Reattempt Charges:

Guest authorizes Tri City Furnished Homes LLC to reattempt failed charges at its discretion until the balance is paid in full, including late fees, transaction fees, and any amounts due under this agreement. Partial approvals may be charged and the remaining balance may be charged in subsequent transactions.


No Contest and Billing Disputes:

Guest agrees not to dispute or charge back any properly authorized charges made in accordance with these terms and the reservation, except in cases of confirmed processing error. Questions about amounts must be raised in writing within 5 business days of the charge posting. Initiation of a chargeback without valid cause is a material breach of this agreement and may result in immediate termination of the reservation and collection activity.


Cancellation and Changes:

This authorization remains in effect through the end of the reservation term unless canceled by guest in strict accordance with the cancellation terms set forth in the agreement (including any notice deadlines). Cancellation requests must be submitted in writing and confirmed received by Tri City Furnished Homes LLC by 5pm-local time, on the 15th of the final month. Canceling the reservation does not waive amounts already incurred or due prior to the effective cancellation date.


Scope of Charges:

In addition to lodging charges, guest authorizes Tri City Furnished Homes LLC to charge the card on file for all amounts owed under the agreement, including but not limited to: taxes and fees; damage, missing items, restoration labor, and excessive cleaning; undisclosed occupant or pet fees; utility overages; bed bug remediation costs outside the reporting window; loss-of-use and relocation costs; fines and penalties; and any attorney’s fees, collection costs, and interest permitted by law.


Electronic Records and Signatures:

Guest consents to the use of electronic records, communications, and signatures for the setup and administration of automatic payments. Electronic acceptance of these terms is binding as an original signature.


Revocation of Authorization:

Guest may revoke this automatic payment authorization only by (a) providing written notice and (b) receiving written confirmation of receipt from Tri City Furnished Homes LLC, and only if all outstanding balances are paid in full and the revocation complies with the agreement’s cancellation terms. Revocation does not affect charges already incurred or scheduled prior to the effective date of revocation.


Errors and Corrections:

If an error in processing results in an incorrect charge, Tri City Furnished Homes LLC will correct the error by refund or additional charge, as applicable. Guest must notify Tri City Furnished Homes LLC in writing of any suspected error within 5 business days of the transaction posting.


Governing Terms:

These automatic payment terms are incorporated into and governed by the residential reservation agreement and its terms and conditions, including enforcement, collections, jurisdiction/venue, and attorney’s fees provisions.


Acknowledgment and Authorization:

By signing below or clicking “ACCEPT” guest acknowledges and agrees to the above terms, authorizes recurring automatic charges on the 15th of each month (or as otherwise scheduled), agrees to the 3.9% transaction fee on each payment, and agrees to a late fee of 10% of the amount due for any declined or returned payment.


Weekly and Bi-Weekly Cleaning


Weekly and Bi-Weekly cleaning services are offered for the convenience of the Guest. Tri City Furnished Homes LLC will perform the following cleaning tasks and scope of work at every service, unless otherwise stated or requested and approved by Tri City Furnished Homes LLC.


Items Included in Cleaning Service; Rinse-load dirty dishes and start dishwasher, wash all dirty towels, sheets and kitchen linens, make beds, clean bathrooms, clean kitchen, clean common areas such as living room and outdoor dining area.


Items Included with extra cost; Replenishing soaps, paper towels, toilet paper, laundry soap and any other consumable personal items. Washing blankets on couches and beds. If you require these items, please request them at your convenience.


Residential Reservation Agreement Terms and Conditions


This License Agreement (this "Agreement") is made effective as of the first day of the GUEST’S RESERVATION, between TRI CITY FURNISHED HOMES LLC, of 3311 Clearwater Ave. STE. D107, Kennewick, Washington 99336, and GUEST.


In this Agreement, the party granting the right to use the licensed property will be referred to as "TRI CITY FURNISHED HOMES LLC", and the party receiving the right to use the limited licensed property will be referred to as "GUEST." The location the Guest is occupying (the "Address of the reservation") will be referred to as the “Lodging Unit.” Payments for this Agreement shall be referred to as the “Lodging Rate.” The term “Reservation” refers to the length of the Residential License Term and shall represent daily, weekly, or monthly lengths of stay.


The parties agree as follows:


1. IDENTIFICATION REQUIREMENTS
All guests aged 18 and older must have a valid ID verified.


2. THIRD-PARTY RESERVATIONS
All third-party reservations require a move-in appointment during business hours (Monday – Friday, 10 AM – 4 PM local time zone) to sign a condition report and complete a physical walkthrough.


3. PARTIES TO THE AGREEMENT
This License Agreement (“Agreement”) is made effective as of the first day of the Guest’s reservation between TRI CITY FURNISHED HOMES LLC (“Licensor”) and Guest.


4. DEFINITIONS

  • Rental Dwelling – The property being occupied by the Guest.
  • Lodging Rate – The total amount paid under this Agreement.
  • Reservation – The duration of the stay, which may be daily, weekly, or monthly


5. GRANT OF LICENSE
TRI CITY FURNISHED HOMES LLC grants the Guest an exclusive, limited license to occupy and use the Rental Dwelling only for paid reservations. This Agreement does not create a landlord-tenant relationship under any local or state Landlord-Tenant law, and it does not convey any leasehold interest, tenancy rights, or ongoing occupancy privileges beyond the paid reservation period. The Guest’s rights are limited to those of a licensee for temporary lodging as defined under applicable law.


6. PAYMENT & REFUNDS
Guest shall pay TRI CITY FURNISHED HOMES LLC the agreed-upon Lodging Rate. All payments are due as specified in the reservation confirmation. No portion of the Lodging Rate is refundable for any reason unless a written cancellation provision is provided through your reservation or a third-party booking platform. Refunds, when approved in writing, will be issued to the original payment method within 15 business days.


7. MONTHLY & WEEKLY REOCCURRING RESERVATIONS
Monthly reservations end on the last day of the month at 10 AM local time zone unless otherwise stated or agreed upon. Guests must email TRI CITY FURNISHED HOMES LLC a cancellation notice by 5 PM local time zone on the 15th day of the final month of the reservation.

Failure to provide a cancellation notice will result in a full month’s charge.If the Guest is receiving a discounted monthly rate, prorated months are not permitted. Discounted rates are defined as reservations billed at a flat monthly rate rather than a standard daily rate.

Prorated entries may be permitted only at the start of a reservation to align the Guest’s billing cycle with the calendar month (for example, paying from the 12th through the end of the month). TRI CITY FURNISHED HOMES LLC does not offer prorated exits; Guests are responsible for the full final month’s charge regardless of early departure.

The Guest must maintain a valid card on file for future recurring charges. Failure to pay by the 15th allows TRI CITY FURNISHED HOMES LLC to begin securing future reservations for any unpaid days in the Rental Dwelling.

Weekly Reservations:
Weekly reservations end on the last day of the reservation at 10 AM local time zone unless otherwise stated or agreed upon. Guests must provide a cancellation notice at least 7 days before the last day of the reservation, and such notice must be received by 5 PM local time zone.Failure to provide a cancellation notice will result in a full week’s charge.If the Guest is receiving a discounted weekly rate, prorated weeks are not permitted. Discounted rates are defined as reservations billed at a flat weekly rate rather than a standard daily rate.

Guests must maintain a valid card on file for recurring reservations. Failure to process payment or any returned transaction permits TRI CITY FURNISHED HOMES LLC to secure future reservations for the Rental Dwelling. Weekly stays require an initial stay of at least 15 days to allow for a proper 7-day cancellation-notice window

8. MODIFICATIONS, NON-PAYMENT & DEFAULTS

Guest may not modify any portion of the reservation without prior written approval from TRI CITY FURNISHED HOMES LLC. In the event of non-payment, a returned transaction, or any other default, TRI CITY FURNISHED HOMES LLC reserves the right to immediately secure future reservations for the Rental Dwelling and terminate the Guest’s license to occupy. No additional notice period is required under this provision.

9. ARBITRATION
Disputes will first be addressed through good-faith negotiation. If unresolved within 30 days, either party may proceed to binding arbitration under the rules of the American Arbitration Association, or another arbitration association if agreed upon by both parties.

10. TRANSFER OF RIGHTS
Neither party may assign this Agreement without prior written consent.

11. TERMINATION & LATE CHECK-OUTS
This Agreement automatically terminates at 10 AM local time zone on the last day of the Guest’s reservation. Late check-outs must be requested at least 24 hours in advance and are subject to approval by TRI CITY FURNISHED HOMES LLC. A $65 per hour late check-out fee will apply for each hour (or portion thereof) that the Guest occupies the Rental Dwelling beyond the scheduled check-out time, rounded up to the next full hour.

14. GOVERNING LAW
This Agreement is governed by applicable local or state transient lodging, hotel, or short-term accommodation laws, as applicable to temporary occupancy agreements - NOT Landlord Tenant Laws.

15. SIGNATORIES
This Agreement must be signed by both TRI CITY FURNISHED HOMES LLC and the Guest to be valid. Electronic signatures and online acceptance are binding and enforceable as original signatures.

16. OCCUPANCY
The Rental Dwelling is for residential lodging use only. All occupants, including adults and minors, must be accurately disclosed at the time the reservation is made. Any occupants not disclosed when the reservation was made and staying more than 24 hours during the reservation period must provide valid identification and are subject to additional lodging fees. Unauthorized or undisclosed occupants will incur an $80 per person, per day fee—or 20% of the daily lodging rate, whichever is greater—and may result in immediate termination of the reservation.TRI CITY FURNISHED HOMES LLC reviews and approves each reservation based on the number of guests and pets disclosed, previous reservations with Guest at booking. Any undisclosed occupants are subject to removal and may cause cancellation of the reservation without refund.

17. RENTAL DWELLING CONDITION
Guest must inspect and accept the condition of the Rental Dwelling upon move-in. Any pre-existing damage or maintenance concern must be reported to TRI CITY FURNISHED HOMES LLC within 24 hours of occupancy. Failure to report will constitute acceptance of the dwelling’s condition as-is. Guest will be held responsible for any damages, missing items, or excessive wear identified after vacating the property.

18. FURNISHINGS
The Rental Dwelling is fully furnished. Guests may not alter, remove, or relocate furniture, décor, or household items. Violations will result in a $65 per hour restoration fee, plus any applicable replacement or repair costs.

If any item, furnishing, décor, or linen must be picked up, delivered, unpackaged, cleaned, or set up due to Guest misuse, loss, or damage, a $65 per man-hour charge will apply for labor in addition to the item’s replacement or repair cost. This includes, but is not limited to, the time required for laundering, folding, transport, setup, and reinstallation of items at the Rental Dwelling.

19. PARKING
Guest must park only in designated parking areas. Unauthorized or street parking may result in towing at the Guest’s expense. TRI CITY FURNISHED HOMES LLC is not responsible for towing costs, citations, theft, or vehicle damage.

20. ELECTRICITY & UTILITIES
Crypto mining, electric vehicle charging, or any other high-consumption electrical activity is strictly prohibited. Any electricity usage outside of normal residential use will be billed to the Guest at the rate determined by TRI CITY FURNISHED HOMES LLC. For reference, “normal residential use” is measured against the average electrical consumption for the same property over the previous twelve (12) months or, if unavailable, against comparable units under standard occupancy. Violations of this section may result in additional billing and/or termination of this Agreement.

21. LEGAL COMPLIANCE
Guest must comply with all local, state, and federal laws, as well as HOA or community regulations. Illegal activity or repeated noncompliance constitutes a material breach of this Agreement and may result in immediate termination without refund.

22. USE & ALTERATIONS
Guest may not make any structural, electrical, or cosmetic changes to the property, including painting, wall mounting, installing fixtures, or altering landscaping. Unapproved modifications will result in restoration and repair costs billed directly to the Guest.

23. BILLING AUTHORIZATION & PAYMENT RESPONSIBILITY
All additional charges incurred under this Agreement, including but not limited to damages, replacement costs, cleaning fees, restoration labor, lost items, pet fines, excessive utility use, or other penalties—may be billed and automatically charged to any valid payment method or card on file with TRI CITY FURNISHED HOMES LLC.

If no valid card is on file, or if a payment is declined, the Guest remains responsible for immediate payment. Interest may be applied to any outstanding balance at the maximum rate permitted by applicable law, in addition to any collection or administrative costs incurred by TRI CITY FURNISHED HOMES LLC.

24. PERSONAL OR ADDITIONAL FURNITURE, MATTRESSES & BEDDING
Guests may not bring, install, or place any personal or additional furniture, mattresses, bedding, or sleeping arrangements into the dwelling without prior written approval from TRI CITY FURNISHED HOMES LLC. This includes, but is not limited to, air mattresses, rollaway beds, sleeper sofas, cots, cribs, or any other furnishings not originally provided by TRI CITY FURNISHED HOMES LLC. Unauthorized items may result in immediate removal, additional cleaning and restoration fees, and potential termination of the reservation without refund.

25. MATTRESS & PILLOW ENCASEMENTS
Each bed and pillow in the Rental Dwelling is equipped with a protective encasement provided by TRI CITY FURNISHED HOMES LLC. These encasements are designed to prevent bedbugs, allergens, and damage to mattresses and pillows. Encasements must remain installed at all times and may not be removed, replaced, or washed by the Guest for any reason. Removal or damage to any mattress or pillow encasement will result in replacement and labor costs billed directly to the Guest.

26. BED BUGS & REPORTING PERIOD
TRI CITY FURNISHED HOMES LLC conducts preventive pest inspections and treatments to ensure each property is free from bed bugs and other pests prior to every Guest arrival.

The Guest is required to inspect the Rental Dwelling immediately upon move-in and must report any evidence or suspicion of bed bugs within ten (10) calendar days of the check-in date. Failure to report within this 10-day period constitutes the Guest’s acknowledgment and acceptance that the Rental Dwelling was delivered in clean, pest-free condition.

After the 10-day reporting period expires, the Guest assumes full and exclusive financial responsibility for any bed bug presence, activity, or infestation discovered during or after their occupancy, regardless of when it is reported.

If bed bugs are found after this period, the Guest shall be responsible for all related costs, including but not limited to:

  • Replacement of all affected furniture, mattresses, linens, and soft goods,
  • Full pest control treatment and follow-up services,
  • Deep cleaning, laundry, and decontamination, and
  • Loss of use or revenue for the Rental Dwelling during the remediation period.


If the Guest fails to cooperate with inspection or intentionally conceals any evidence of infestation, this will be considered willful negligence and grounds for immediate termination of the reservation, with no refunds and full cost recovery by TRI CITY FURNISHED HOMES LLC

27. LOSS OF USE, CONCEALMENT, & FAILURE TO REPORT DAMAGES
The Guest must immediately report any damage, malfunction, or maintenance issue in the Rental Dwelling as soon as it is discovered. Concealing, ignoring, or failing to report damages or maintenance concerns is strictly prohibited and constitutes a material breach of this Agreement.

If TRI CITY FURNISHED HOMES LLC discovers that the Guest failed to report or concealed any damage, maintenance need, or condition affecting the property’s habitability, the Guest will be held fully responsible for all related costs, including but not limited to:

  • Full repair or replacement costs for damaged items, fixtures, or systems,
  • Loss of use and lost rental income during repair or restoration,
  • Guest relocation costs for displaced incoming reservations,
  • Hotel or upgrade expenses incurred for relocated guests, and
  • Administrative and scheduling costs associated with coordinating repairs or alternative housing.


All such costs and damages may be automatically charged to any valid payment method on file with TRI CITY FURNISHED HOMES LLC, as authorized under Section 23. If no valid payment method is available or payment is declined, the Guest will remain liable for the outstanding balance, and interest, collection fees, and legal recovery costs may be added as permitted by law.

Intentional concealment, property neglect, or tampering with maintenance items (including disabling smoke detectors, turning off water shutoffs, or blocking access panels) may result in immediate termination of the reservation, forfeiture of all lodging fees, and pursuit of civil recovery for full losses incurred.

28. CLEANLINESS & MAINTENANCE
Guest must maintain the Rental Dwelling in a clean, orderly, and sanitary condition at all times. This includes routine cleaning of bathrooms, kitchens, floors, and all living areas, as well as regular trash removal and laundering of linens.

If the dwelling is left in an unsanitary condition—such as excessive dirt, trash accumulation, food residue, strong odors, or neglected cleaning—the Guest will be responsible for all associated costs, including but not limited to:

  • Professional deep cleaning and deodorization,
  • Air purification or ozone treatment,
  • Furniture and linen replacement if damaged or soiled, and
  • Loss of use or relocation costs for delayed or canceled incoming reservations.


TRI CITY FURNISHED HOMES LLC offers professional cleaning services during the reservation period, and Guests are strongly encouraged to schedule regular cleaning—particularly for extended stays or group housing. Failure to maintain routine cleanliness or hire cleaning services when needed may result in immediate termination of the reservation, forfeiture of lodging fees, and billing for all related costs.

TRI CITY FURNISHED HOMES LLC reserves the right to perform periodic cleanliness inspections with reasonable notice to ensure compliance with this provision. All related charges may be automatically billed to any payment method on file as authorized in Section 23.

29. NEGLIGENCE, DAMAGE & MISUSE
Guest shall exercise reasonable care in the use of all furnishings, appliances, fixtures, and systems within the Rental Dwelling. Any damage, malfunction, or loss resulting from Guest negligence, misuse, abuse, or failure to follow written instructions will be the sole financial responsibility of the Guest. This includes, but is not limited to:

  • Damage to flooring, furniture, plumbing, electrical, HVAC, or appliances caused by improper use or neglect,
  • Overloading washers, dryers, or dishwashers,
  • Failure to secure windows, doors, or utilities during inclement weather, and
  • Damage caused by guests, invitees, or service providers permitted by the Guest.


TRI CITY FURNISHED HOMES LLC may immediately arrange for repair or replacement without prior notice if needed to protect the property. All related costs—including labor, materials, administrative coordination, and loss of rental income—will be automatically billed to any payment method on file as authorized in Section 23. If no valid payment method is available, the Guest remains responsible for full reimbursement, and unpaid balances may accrue interest and collection costs to the fullest extent permitted by law.

30. HAZARDOUS MATERIALS & SAFETY VIOLATIONS
For the safety of all occupants, hazardous, flammable, or combustible materials are strictly prohibited anywhere within the Rental Dwelling, garage, storage areas, or surrounding property. Prohibited items include—but are not limited to—gasoline, propane tanks, lighter fluid, fireworks, toxic or corrosive chemicals, open flames, or any device that poses a fire or explosion risk.

Tampering with smoke detectors, carbon-monoxide alarms, fire extinguishers, or circuit breakers is expressly forbidden and constitutes grounds for immediate termination of the reservation. If such activity results in property damage, injury, or governmental fines, the Guest will be held fully liable for all resulting costs, including emergency response, remediation, and loss of use.

TRI CITY FURNISHED HOMES LLC reserves the right to remove any hazardous materials found on site and charge the Guest for all associated costs, including inspection, cleanup, and disposal.

31. REPORTING HAZARDS, LEAKS & FAILURES
Guest have an ongoing duty to promptly report any condition that could pose a safety risk or cause damage to the property. This includes—but is not limited to—water leaks, mold, pest activity, electrical issues, unusual odors, malfunctioning appliances, or structural concerns.

Failure to immediately report a hazard or maintenance issue may result in the Guest being fully responsible for all resulting damage, remediation, and loss of use of the Rental Dwelling. If such failure leads to delay in repairs, additional property damage, or cancellation of an incoming reservation, the Guest will also be liable for lost rental income and guest relocation costs.

Reports must be made directly to TRI CITY FURNISHED HOMES LLC through the designated maintenance contact or phone number listed in the Guest Welcome Information. Intentional concealment or interference with maintenance staff will be treated as willful negligence and may result in termination and collection action.

32. NUISANCE, CRIMINAL ACTIVITY & LAW ENFORCEMENT DISCLOSURE
Guest and all occupants must conduct themselves in a safe, lawful, and respectful manner at all times. Any behavior or activity that disturbs neighbors, violates community standards, or results in law enforcement involvement is strictly prohibited.

The following shall constitute immediate grounds for termination of this Agreement without refund and removal from the property:

  • Any criminal activity, arrest, or citation occurring on or around the premises,
  • Any law enforcement presence or investigation initiated in connection with the Guest, occupants, or their invitees, regardless of cause,
  • Failure to disclose a prior or current criminal conviction, active warrant, or probation status,
  • Failure to disclose that any occupant is a registered sex offender or under court-ordered supervision,
  • Use of the property for unlawful purposes or activities that pose a safety risk to the community


Guests are required to immediately notify TRI CITY FURNISHED HOMES LLC of any law enforcement contact, investigation, or arrest occurring during their reservation, whether on or off the property. Failure to report such incidents shall be treated as material misrepresentation and grounds for termination.

In the event of violation, TRI CITY FURNISHED HOMES LLC may:

  • Cancel the reservation immediately,
  • Require all occupants to vacate the property,
  • Forfeit all paid lodging fees, and
  • Bill the Guest for any resulting loss, damage, or cost of relocating future guests.


All associated costs—including cleaning, restoration, and lost rental income—may be automatically charged to any valid payment method on file, as authorized in Section 23.

33. ENTRY BY TRI CITY FURNISHED HOMES LLC
TRI CITY FURNISHED HOMES LLC and its authorized agents, contractors, or representatives reserve the right to enter the Rental Dwelling at any time deemed reasonably necessary to protect the property, ensure compliance with this Agreement, or perform inspections, maintenance, cleaning, pest control, or repairs.

Whenever possible, reasonable notice will be provided; however, in cases of emergency, suspected violations, safety risks, or potential property damage, entry may occur without prior notice.

Guests shall not deny, obstruct, or delay access to the property. Doing so constitutes a material breach of this Agreement and may result in immediate termination of the reservation without refund and additional charges for any damages, delays, or missed maintenance appointments.

Repeated refusal of entry or hostile behavior toward management, staff, or contractors may also result in permanent denial of future booking privileges and full liability for all resulting financial losses.

TRI CITY FURNISHED HOMES LLC may document any inspection or entry through photographs, videos, or written reports as evidence of condition or compliance.

34. LIABILITY, INDEMNIFICATION & HOLD HARMLESS

Guest accepts full and unconditional responsibility for all persons, personal property, and activities occurring in or around the Rental Dwelling during their reservation period.

Guest agrees to indemnify, defend, and hold harmless TRI CITY FURNISHED HOMES LLC, its owners, officers, employees, contractors, and affiliates from and against any and all claims, actions, damages, losses, injuries, costs, or expenses (including attorney’s fees) arising from or related to:

  • The Guest’s occupancy, conduct, or use of the property,
  • Acts or omissions of the Guest, occupants, or their visitors,
  • Negligence, misuse, or violation of this Agreement,
  • Damage or injury caused to any person or property, or
  • Any incident involving pets, invitees, or unauthorized occupants.

This indemnification applies to the fullest extent permitted by law and survives termination, expiration, or cancellation of this Agreement. The Guest further agrees that TRI CITY FURNISHED HOMES LLC shall not be liable for any loss or damage to personal property, vehicle, or person, whether by theft, accident, weather, or otherwise, and that the Guest waives all right of subrogation or recovery from the company.

Any claims or costs resulting from the Guest’s acts or omissions may be immediately billed and automatically charged to any valid payment method on file, as authorized in Section 23.

35. ASSIGNMENT, SUBLETTING & UNAUTHORIZED OCCUPANCY
This Agreement is non-transferable. Guest may not assign, sublet, or otherwise transfer occupancy of the Rental Dwelling or any portion thereof to another person, business, or entity without the prior written consent of TRI CITY FURNISHED HOMES LLC.

Unauthorized occupancy, including but not limited to third-party bookings, rotating employees, unapproved guests, or corporate substitutions, constitutes a material breach of this Agreement. TRI CITY FURNISHED HOMES LLC may immediately terminate the reservation, require all unauthorized occupants to vacate, and retain all paid lodging fees.

If such activity results in cancellation, relocation of other guests, or damage to reputation, the Guest will be liable for all resulting costs, including lost income, replacement housing, cleaning, and legal expenses. Any damages, costs, or penalties under this section may be automatically charged to any valid payment method on file, as authorized under Section 23.

Intentional misrepresentation or concealment of occupants or booking purpose (including third-party “proxy” bookings) will result in permanent denial of future reservations and potential civil action for recovery of losses.

36. PET POLICY & RESPONSIBILITY
All pets must be pre-approved in writing prior to occupancy. Pet fees vary by property and location and must be paid before move-in. Unauthorized pets or animal types will result in immediate termination of this Agreement, forfeiture of lodging fees, and additional cleaning or deodorization charges.

Guests are fully responsible for all pet-related damages, including scratching, chewing, odor, stains, or destruction of furniture, flooring, doors, or landscaping. Failure to remove pet waste promptly will result in a $200 fine per occurrence, and any damage requiring replacement of flooring or furniture will be billed at full cost.

Guests must provide proof of active pet liability insurance with coverage of no less than $100,000 per animal before occupancy. Pets must be properly vaccinated, non-aggressive, and not left unattended unless kenneled or crated.

If any pet has a known history of aggression, prior incidents, or behavioral issues, this must be disclosed in writing prior to arrival. Failure to disclose an animal’s prior aggressive behavior constitutes a material breach of this Agreement.

The Guest is fully and exclusively liable for any injury, claim, or damage to persons, property, or other animals caused by their pet, regardless of location or circumstance. All veterinary, medical, property repair, or legal costs associated with a pet incident will be billed directly to the Guest and automatically charged to any valid payment method on file.

If any pet causes a nuisance, safety issue, or property damage, TRI CITY FURNISHED HOMES LLC may require immediate removal of the animal and may terminate the reservation without refund.

By signing this Agreement, the Guest acknowledges and accepts full and unconditional responsibility for all actions, behaviors, and activities of any pet brought onto the property during their stay.


37. MOVE-IN, MOVE-OUT & INSPECTION REQUIREMENTS

  • Move-In: 3:00 PM – 5:00 PM (local time zone)
  • Move-Out: 10:00 AM (local time zone)


Guest must complete an initial walkthrough of the Rental Dwelling upon arrival and report any issues, damage, or discrepancies within 24 hours of check-in. Failure to report within this period shall constitute the Guest’s acceptance that the property was delivered in clean, safe, and fully functional condition.

Late check-outs must be requested in writing at least 24 hours in advance and are subject to written approval from TRI CITY FURNISHED HOMES LLC. Unauthorized late departures will incur a $65-per-hour fee, rounded up to the next full hour, plus any loss-of-use charges resulting from turnover delays or displaced incoming reservations.

Guests must remove all personal belongings and leave the Rental Dwelling in clean, rentable condition. If damage, neglect, or excessive mess prevents the next scheduled guest from checking in, the departing Guest will be fully liable for all associated expenses, including:

  • Professional cleaning, repair, or restoration;
  • Relocation or hotel costs for the incoming guest; and
  • Lost rental income and administrative coordination fees.


A post-departure inspection will be performed by management. Any unreported damage, missing items, or property misuse identified after move-out will be billed directly to the Guest and automatically charged to any valid payment method on file.

38. TERMINATION FOR VIOLATIONS

TRI CITY FURNISHED HOMES LLC reserves the right to immediately terminate this Agreement without refund if any Guest, occupant, invitee, or pet violates any term of this Agreement, engages in illegal, unsafe, or disruptive conduct, or causes damage to the property, neighboring homes, or community reputation.

Grounds for immediate termination include, but are not limited to:

  • Criminal, violent, or threatening behavior;
  • Property damage, theft, or vandalism;
  • Law enforcement presence or arrest of any occupant;
  • Unauthorized guests, pets, or subletting;
  • Concealment or failure to report maintenance or safety issues;
  • Disorderly conduct, intoxication, or disturbances to neighbors;
  • Smoking, vaping, or use of prohibited substances on premises;
  • Use of the property for unlawful or misrepresented purposes; or
  • Any activity creating risk to health, safety, or quiet enjoyment.


Upon termination, Guest and all occupants must vacate the premises immediately upon notice. TRI CITY FURNISHED HOMES LLC may remove all personal property left behind, re-secure the dwelling, and retain all paid lodging fees to offset damages, cleaning, and lost income.


If the violation causes the company to cancel or relocate another guest, the violating Guest will be liable for all related relocation, cleaning, and operational costs, including:

  • Rehousing expenses for incoming guests,
  • Deep cleaning, repair, or odor remediation,
  • Lost rental revenue, and
  • Administrative and legal fees. 


All such charges will be automatically billed to any valid payment method on file and, if unpaid, may accrue interest, collection costs, and legal recovery fees to the fullest extent permitted by law.


39. ATTORNEY’S FEES, ENFORCEMENT & COLLECTION RIGHTS

If any dispute, enforcement, or arbitration proceeding arises under this Agreement, the prevailing party shall recover all attorney’s fees, arbitration costs, enforcement expenses, and administrative fees, whether before or after judgment.


If TRI CITY FURNISHED HOMES LLC must pursue collection or enforcement to recover unpaid balances, damages, or penalties, the Guest shall be liable for:

  • All collection agency fees, administrative costs, and interest at the highest rate permitted by law,
  • Court costs, arbitration fees, filing fees, and attorney’s fees, and
  • Any additional fees incurred in securing judgment, garnishment, or enforcement.


Guest expressly agrees that TRI CITY FURNISHED HOMES LLC may pursue collection in the jurisdiction where the Rental Dwelling is located, and that all legal costs and accrued interest will continue until the balance is satisfied. This section shall survive termination or expiration of this Agreement.


40. SMOKING, ODOR & AIR QUALITY POLICY

Smoking, vaping, or burning of any substance—including but not limited to tobacco, marijuana, incense, candles, or chemical sprays—is strictly prohibited anywhere inside the Rental Dwelling, garage, or covered patio, unless expressly approved in writing.


Evidence of smoking, odor, or residue constitutes a material breach of this Agreement. Guests will be charged for:

  • Full replacement or professional deodorization of affected furniture, flooring, drapery, or HVAC systems,
  • Ozone or air purification treatments, and
  • Loss-of-use and rebooking costs for every day the property remains unrentable.


Tampering with or disabling smoke detectors, covering vents, or attempting to mask odors will result in immediate termination without refund and full recovery of cleaning, replacement, and remediation expenses. All such costs will be automatically charged to any valid payment method on file.


41. PET CONDUCT & BEHAVIOR

Pets must remain kenneled, crated, or securely contained whenever left unattended inside the dwelling. Guests must prevent excessive noise, odor, or disturbances to neighbors or the community.


If a pet causes noise complaints, odor, or property damage—including to flooring, doors, furniture, or landscaping—the Guest will be billed for full replacement or repair costs and a $200 fine per occurrence.


Repeated or severe violations may result in the immediate removal of the animal, termination of the reservation without refund, and denial of future stays.


By signing this Agreement, the Guest acknowledges full responsibility for the actions, behavior, and impact of all pets brought to the property during their stay.


42. CLEANING REQUIREMENTS AT MOVE-OUT

Guest must leave the Rental Dwelling in clean, rentable condition by performing the following before checkout:

  • Remove all trash, food, and personal items;
  • Wipe all counters, appliances, and surfaces; and
  • Start the dishwasher before departure.


Failure to comply will result in additional cleaning charges. Any personal items left behind will be deemed abandoned and may be disposed of at the Guest’s expense.


If TRI CITY FURNISHED HOMES LLC must hire professional cleaning, deodorization, or waste removal to return the property to rentable condition, all such costs—including administrative coordination—will be automatically charged to any valid payment method on file.


43. EXCESSIVE CLEANING, DAMAGE & RESTORATION FEES

If turnover cleaning requires more time, effort, or repair than standard procedures, the Guest will be billed $65 per man-hour for additional cleaning or restoration services. This includes, but is not limited to:

  • Removal of stains, odors, or smoke residue;
  • Trash removal or deodorization;
  • Carpet, upholstery, or appliance restoration; and
  • Deep cleaning of kitchens, bathrooms, or flooring beyond normal wear.


If TRI CITY FURNISHED HOMES LLC must delay or cancel an incoming reservation due to property condition, the departing Guest will be responsible for lost income, relocation costs, and administrative coordination fees.


44. WASHER & DRYER USE

Only HE (High Efficiency) detergent may be used in all washing machines. Guest is responsible for any damage, maintenance, or repair required due to misuse, overloading, or use of non-HE detergents. Repair or replacement costs will be billed directly to the Guest and automatically charged to any payment method on file.


ACKNOWLEDGMENT


By signing this Agreement or clicking “ACCEPT” the Guest acknowledges that they have read, understood, and agree to comply with all terms and conditions contained herein. The Guest understands this is a temporary lodging license, not a residential lease, and is not governed by any local or state landlord-tenant laws.


Guest further acknowledges that TRI CITY FURNISHED HOMES LLC may immediately enforce all terms of this Agreement, including termination, charge authorization, and collection of damages or costs.
